Are Pardons no longer available?

  • Pardons are not being cancelled.
  • The government simply changed the name from “Pardon” to “Record Suspension” and they made the rules tougher.
  • Pardon means “to forgive”.  The Federal Government is no longer in the business of forgiveness.

Applying Under the New Record Suspension Rules

  • Getting a Record Suspension under the new rules is harder than getting a Pardon under the old rules.
  • You must now wait longer before being eligible to apply.
  • Some people are now banned from applying for a Record Suspension.
  • The Parole Board has new discretionary powers to deny a Record Suspension even if the applicant has met the basic eligibility criteria. 

How to Avoid a Denial of a Record Suspension Application

  • Avoid traffic violations and other non-criminal violations.
  • Do not associate with known criminals.
  • Avoid domestic disputes and arguments with neighbors.
  • Ensure all fines are paid and there are no outstanding warrants or pending charges.
  • Any time there is police involvement, even if no conviction results, there is a risk the Parole Board may propose to deny your application. 
  • You may also be required to attend a treatment program to satisfy the Parole Board you are no longer likely to reoffend.
  • If you hire us, we will assess your specific situation and let you know if we think your application is at risk of being denied.  We’ll also assist in helping you avoid the risk of denial.

Who Can Apply Under the Old Rules?

  • Currently, only residents of BC and Ontario can apply under the rules that existed at the time they offended. 
  • Applicants currently living in BC and Ontario that offended prior to 2012-03-13 can apply for a Pardon.   
  • All other Applicants must apply under the stricter “Record Suspension” rules.
  • It’s only a matter of time before the same rights are extended to the rest of Canada.

Impact of Criminal Record – Finding a Job

  • Studies show ex-offenders earn up to 40% less, take longer to find a job and are offered few promotions.
  • 95% of employers ask applicants if they have a criminal record.  Criminal record screening is becoming the norm.

Impact of Criminal Record – Wages

  • If someone with a criminal record takes 6 months longer to find a job, is forced to take a job beneath his or her skill set earning $10,000.00 less per year, then over a 5-years period, a shocking $90,000.00 is lost in wages.
  • Example:  if their salary is $60,000.00, the loss represents $30,000.00 in lost wages for 6 months and a loss of $10,000 per year for 6 years.
  • For most past offenders, this loss of income is disproportionate to the offence committed. I don’t recall the judge saying “We sentence you to lost wages of $90,000.00 over the next 5 years”!

Impact of a Criminal Record – Family

  • Financial difficulties increase the risk of divorce. 
  • When you create more opportunities for you, you create more opportunities for your children.
